Agreement

These Terms of Service apply to your use of cmainow.com (the "Site"), which is operated by Creative Marketing AI ("CMAi", "we", "us"), 1091 Indian Trail Dr, Mount Vernon, IL 62864.

By using the Site you agree to these terms. If you do not agree, please do not use the Site.

What CMAiNow is

CMAiNow is a local directory of venues and events. We gather information from venues, ticket sellers and public sources and show it in one place so you can find something to do.

We do not run the venues, organize the events or, unless a page says so, sell tickets. A venue or event listed here is not an endorsement by us.

Event and venue information

Dates, times, prices, menus, hours and availability change, and some of what we show may be out of date or wrong. Please confirm details with the venue before you go.

We are not responsible for cancellations, changes, or anything that happens at a venue or event.

Tickets and third-party links

Tickets and reservations are sold by the venue or a third-party seller under their own terms, prices, fees and refund rules. Links to other websites are for your convenience, and we do not control or endorse them.

Venue listings and claiming a listing

Anyone may ask to claim a listing for a venue they own or are authorized to manage. You must not claim or edit a listing for a business you are not authorized to represent.

If you give us content, such as photos, descriptions, hours or events, you confirm you have the right to share it. You give us a non-exclusive, worldwide, royalty-free license to display, copy, adapt and distribute that content on CMAiNow, in our apps and in connected Creative Marketing AI services, and to promote CMAiNow. You keep ownership of your content, and you can ask us to remove it at any time.

We may edit, hide or remove any listing or content at our discretion, for example if it is inaccurate, misleading, unlawful or out of date.

Unclaimed listings

We may list a venue using publicly available business information, such as its name, address, phone number and website, before the venue has claimed the listing. If you represent a venue and want a listing corrected or removed, tell us on the correct-or-remove page and we will act on it promptly.

Acceptable use

• Do not use the Site for anything unlawful, deceptive or harmful.
• Do not scrape, copy or republish large parts of the Site, or use automated tools to access it in bulk, without our written permission.
• Do not try to disrupt, overload or break into the Site or its systems.
• Do not submit false or misleading information, or pretend to be someone you are not.

Intellectual property

The Site, its design, software and the CMAiNow name and logo belong to CMAi. Venue names, logos, photos and event content belong to the venues or their owners. Other trademarks belong to their respective owners.

Copyright and takedown requests

If you believe content on the Site infringes your copyright, email [email protected] with your name and contact details, a description of the work, the page address where it appears, a statement that you believe the use is not authorized, and a statement that your notice is accurate. We will review it and remove content when appropriate.

No warranty

The Site is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that the Site or its information will be accurate, complete, available or error-free.

Limitation of liability

To the fullest extent the law allows, CMAi is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site or from any venue or event. Our total liability for any claim relating to the Site is limited to $100. Some places do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Illinois, and you agree to their jurisdiction.

Changes

We may update these terms from time to time. The new version will be posted here with a new date. Using the Site after a change means you accept it.
